Terms of Service
topbit Protocol Interface
Effective Date: These Terms take effect on the day the casino opens for real-money play and apply to your use of the Interface from that day forward.

About this draft. topbit is an early-stage, decentralised protocol. We have written these Terms to describe the Service plainly and accurately. They are not legal advice, and we will confirm specific clauses (notably Section 13, Governing Law) with qualified counsel before or shortly after launch. Every control described here is one we actually operate, except where we mark it as still in development.
1. Agreement to These Terms
By accessing the topbit interface at topbit.io (the "Interface"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Interface.
These Terms are a legally binding agreement between you and topbit Protocol ("we," "us," or "the Protocol"). The Protocol is a set of smart contracts deployed on the Solana blockchain. The Interface is a front-end that lets you interact with those contracts.
2. The Protocol Is Not a Casino Operator
topbit is a non-custodial protocol. We do not take custody of your funds, and we are not the counterparty to your bets. Your funds stay in on-chain escrow that you control, and winnings are paid from on-chain vaults funded by independent liquidity providers.
The games are operated by third-party game providers. The game logic, odds, random outcomes, and return-to-player rates are determined by the provider, not by us. We integrate the games and settle their results on-chain; we do not set or control their outcomes.
None of this changes your obligations under Section 3.
3. Eligibility
You may use the Interface only if all of the following are true. Read them carefully.
- 1.Age. You are at least 18, or the legal gambling age where you live, whichever is higher.
- 2.Jurisdiction. You are not in a Restricted Territory (below), and you are not anywhere else that prohibits online gambling.
- 3.Capacity. You can enter into a binding contract under the laws that apply to you.
- 4.Clean funds. The money you gamble is your own and is not the proceeds of crime.
- 5.Not self-excluded. You are not currently self-excluded from any gambling service.
Restricted Territories
We do not permit real-money play from:

- •Portugal
- •Romania
- •Czech Republic
- •Poland

- •Iran, North Korea, Cuba, and Syria (comprehensively sanctioned)
We technically enforce a subset of this list at the network edge and re-check your location at wallet connect (see our AML Policy, which names the currently enforced countries, and our Privacy Policy). We may add to the enforced set at any time. Whether or not we detect your location, you must not use the Interface from any territory listed above, from any sanctioned jurisdiction, or from anywhere online gambling is prohibited.
By using the Interface, you represent and warrant that every statement in this section is true of you. If any is false, you are in breach of these Terms and accept full legal and financial responsibility for the consequences.
4. Risk Acknowledgment
Gambling means you can lose money. By using the Interface, you accept the following risks:
- 1.You may lose everything you bet. Every game has a built-in house edge, set by the game provider. Over time, the house edge means players as a whole lose money.
- 2.Smart contract risk. The Protocol is software. Audits reduce risk but cannot eliminate it, and deployed contracts are immutable: we cannot reverse a transaction or recover funds lost to a bug.
- 3.Randomness and oracle risk. Random outcomes are produced by the game provider's own random number generator. Provider or network disruptions may delay settlement; an incomplete bet may be refunded.
- 4.Blockchain risk. Solana congestion, forks, or outages can affect your ability to bet or withdraw.
- 5.Regulatory risk. Gambling law varies and changes. Keeping track of the law where you live is your responsibility.
- 6.Liquidity risk. Winnings are paid from liquidity pools. In extreme cases, a vault may not cover a payout. We use floor guards and circuit breakers to manage this, but we cannot guarantee solvency.
- 7.Price risk. Balances and winnings are denominated in USDC, a US-dollar stablecoin. If you fund or cash out in another token through the optional swap, crypto prices move and you may receive more or less than you expected.
5. Prohibited Conduct
You agree not to:
- 1.Use bots, scripts, or automated tools against the Protocol.
- 2.Exploit bugs or vulnerabilities. If you find one, report it to [email protected] before doing anything else.
- 3.Use the Protocol to launder money or fund illegal activity.
- 4.Use a VPN, proxy, or similar tool to get around our jurisdiction restrictions.
- 5.Run multiple accounts or collude with others to manipulate outcomes.
- 6.Use the Protocol as a Politically Exposed Person without our prior written approval.
- 7.Reverse-engineer or copy the Interface, or build derivative works from it.
If you break these rules, we may end your access and forfeit any balance you hold in the Protocol's off-chain components.
6. Intellectual Property
The topbit name, brand, logo, and Interface design belong to the Protocol and its contributors. The smart contracts are open-source and free to review. Using our brand or Interface for a competing product without written permission is prohibited.
7. Wallet Security
Your wallet and private keys are your responsibility. We will never ask for your private key or seed phrase. If your wallet is compromised, we cannot reverse what an attacker does with it. Session keys used for gameplay are scoped to topbit instructions only; they cannot drain your wallet or reach your other assets.
8. Responsible Gambling
Gambling should be entertainment, not income. Please read our Responsible Gambling Policy before you play. If you think you may have a gambling problem, use the self-exclusion tool described there; it takes effect immediately.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- 1.The Protocol and its contributors provide the Interface and smart contracts "as is," with no warranty of any kind.
- 2.We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill.
- 3.Our total liability for any claim will not exceed the amount you wagered in the 30 days before the claim arose.
If your jurisdiction does not allow some of these limits, they apply to the fullest extent it does allow.
10. Indemnification
You agree to indemnify the Protocol, its contributors, and the Interface provider against any claim, loss, or cost (including legal fees) arising from your use of the Interface, your breach of these Terms, your violation of another party's rights, or your use of the Interface from a restricted jurisdiction.
11. AML and Compliance
You agree to cooperate with our anti-money-laundering procedures, described in our AML Policy. We may request identity verification, suspend access, or report suspicious activity where the law requires. Winnings derived from illegal activity may be forfeited.
12. Changes to These Terms
We may change these Terms. We will announce significant changes on the Interface at least 7 days before they take effect. Continuing to use the Interface after that point means you accept the revised Terms.
13. Governing Law and Dispute Resolution
We will confirm the governing jurisdiction and dispute-resolution process with qualified counsel before or shortly after launch, and update this section then.
14. Severability
If any provision of these Terms is unenforceable, the rest remain in force.
